Warranty Terms
General Terms
Norcott Instrumentation warrants that any of
our instrumentation products will be free of defects in materials
and workmanship that result in failure of the product during
normal operation subject to the following terms and conditions:
The product must have been purchased or supplied
as new from Norcott Instrumentation or one of its appointed distributors.
You are able, if required to provide proof of
purchase that includes the shipment date.
Warranty Period
The limited warranty period is 12 months from
date of purchase or receipt.
Repair or Replacement
of Product under Warranty
During the Warranty Period Norcott Instrumentation will
repair, or replace the product at Norcott Instrumentation's sole discretion.
Any defective parts may be replaced with new
or refurbished parts as we determine necessary to achieve
proper operation of the product.
Exclusions
This warranty does not apply to products where:
Damage is caused by abnormal use or conditions,
misuse, neglect, abuse, accident, improper handling or storage,
exposure to moisture, unauthorised modifications, alterations,
or repairs.
Improper installation, improper use of any electrical
source, undue physical or electrical stress, operator error,
non-compliance with instructions or other acts which are not
the fault of Norcott Instrumentation, including damage or loss during
shipment.
Damage from external causes such as floods,
storms, fires, sand, dirt, earthquakes, an Act of God, exposure
to excessive sunlight, weather, moisture, heat, or corrosive
environments, electrical surges, battery leakage or theft.
Any Product that has had its serial number altered,
defaced or removed.
Any Product that has been purchased second-hand.
Any defect that has occurred after the expiration
of the Warranty Period.
Extension of Warranty
The warranty period will be extended for each
day that the product is out of your possession for repair
under this warranty.
Any replacement parts or product will be covered
for the remainder of the warranty period of the original product,
or 3 months, whichever is greater.
Labour and Replacement
Parts
Norcott Instrumentation will pay all part and labour charges
incurred by repairing or replacing defective parts during
the warranty period.
Returning Product under
this Warranty
If a problem develops during the warranty period,
please refer to the Product Returns section of the Product
Support Pages on our website.
These pages will provide you with advice on
how to obtain a Returns Authorisation Number (RAN). Products
will not be accepted for repair without a RAN.
If requested, you must provide proof of purchase
for the Product.
You will bear the cost of shipping the Product
to Norcott Instrumentation. Norcott Instrumentation will pay the cost of shipping
the Product back to you, after completing the warranty service.
Invalid Warranty Claims
If in our opinion the product has been subject
to any of the events in the exclusion section above we will
immediately inform you that the product cannot be repaired
under the terms of our Limited Product Warranty.
We will then offer to repair or replace the
product against a repair quotation, or return the product
to you. In either case you will be responsible for all shipping
and handling charges.
If the returned product is found to be operating
correctly (No Fault Found) then you will be responsible for
all shipping and handling charges to return the product to
you.
Limits of Liability
Our liability in respect of death or personal
injury caused by our negligence is unlimited.
Our liability in respect of any and all claims
(whether in contract or in tort) arising out of or in connection
with this limited liability product warranty shall not in
the aggregate exceed the price of the products supplied.
Notwithstanding anything else contained in these
limited product warranty terms, in no event shall we be liable
to you for; economic loss (which includes loss of profit,
business, goodwill, revenue or anticipated savings); loss
arising from any claim made against you by a third party;
special indirect or consequential loss or damage; loss or
damage arising from your failure to comply with your obligations
to us or any matter under your control; howsoever caused and
even if foreseeable or contemplated by you.
Entire Agreement
This is the entire warranty between you and
Norcott Instrumentation and supercedes all prior agreements or understandings,
oral or written, relating to the Product.
No representation, promise or condition not
contained herein will modify these terms.
Contract Law
All contracts are deemed to have been made in
England and shall be governed in all respects by English law
and the English Courts shall have jurisdiction to settle any
disputes that may arise out of or in connection with any contract.
